Tesla won its bid to revive a London lawsuit seeking a licence on FRAND terms for 5G patents, a reversal the Supreme Court delivered and which clears the way for further proceedings to revive a London lawsuit.
The case began when Tesla sued InterDigital and Avanci at London's High Court in 2023, and InterDigital and Avanci successfully asked the court to dismiss Tesla's request to fix FRAND terms, a decision the High Court made in 2024 and the Court of Appeal upheld before Tesla took the matter to the Supreme Court unsuccessfully appealed.
Laurie Fitzgerald, president of Avanci Vehicle, said, "We respectfully disagree with today's decision and continue to believe Tesla's claims are without merit," a terse response from the licensing platform Avanci.
Reuters noted Tesla's separate challenge to revoke three InterDigital patents survived the earlier rulings and could continue, and the litigation is now expected to return to the High Court.
Avanci, which aggregates licences from multiple patent owners largely for automotive uses, remains a central counterparty in the dispute which licenses patents from multiple owners, largely for automotive uses.
